Terms of Service

BlazingNode (“BlazingNode”, “we”, “us”, or “our”) is a commercial trade name and online infrastructure service operated by Evolution in Motion Inc., a corporation incorporated under the federal laws of Canada, located in the Province of Quebec.

BlazingNode provides access to Polygon blockchain infrastructure, including private RPC endpoints, public community endpoints, WebSocket feeds, and related developer services.

By accessing or using any part of the service, you agree to these Terms of Service.

BlazingNode provides technical infrastructure only.

The service is designed to:

• enable blockchain data access
• support automated systems, applications, and analytics
• provide reliable infrastructure for Polygon-based operations

BlazingNode does not:

• provide financial, trading, or investment advice
• guarantee transaction execution or outcomes
• guarantee profitability or performance results

All decisions and actions taken using the service are the sole responsibility of the user.

Users are responsible for:

• maintaining the confidentiality of account credentials
• securing API keys and access tokens
• all activity associated with their account

BlazingNode is not liable for:

• unauthorized access
• compromised credentials
• misuse of API keys

Users must notify BlazingNode immediately of any suspected security breach.

Payments

• All payments are made in USDC or supported digital assets.
• Services are prepaid and non-recurring unless otherwise specified.
• Access is granted only for the paid period.
• Multi-month discounts may be offered.

Unless explicitly stated:

• all payments are final
• no refunds are provided

Digital Asset Transactions and Irreversibility: All payments made using digital assets (including native USDC on Polygon PoS) are strictly prepaid, final, and non-refundable. Users are solely responsible for verifying the correct chain ID (Polygon PoS, Chain ID 137), token contract address, and recipient wallet address. BlazingNode does not offer recovery services for tokens sent to incorrect addresses or via unsupported networks. Recurring subscriptions managed via smart contract token allowances remain active until explicitly revoked or cancelled by the user through their wallet or account console.

Taxes

Prices are exclusive of applicable taxes unless otherwise stated.

For customers located in Canada:

• Quebec residents are charged 5% GST and 9.975% QST.
• Customers in other Canadian provinces are charged 5% GST.

BlazingNode does not currently collect HST outside Quebec.

Customers are responsible for:

• determining applicable taxes in their jurisdiction
• complying with local reporting obligations

Each plan includes defined usage limits, including but not limited to requests per second (RPS) and monthly request volume.

BlazingNode reserves the right to enforce limits through:

• request throttling
• temporary restrictions
• required plan upgrades

BlazingNode may also intervene in cases of abnormal or excessive usage that threatens system stability.

BlazingNode aims to provide stable and predictable infrastructure.

However, users acknowledge:

• blockchain networks are inherently variable
• latency, throughput, and response times may fluctuate
• external network conditions may affect service behavior

BlazingNode does not guarantee:

• execution speed
• transaction inclusion
• mempool accuracy

Hard Forks and Protocol Halts: In the event of a blockchain network hard fork, software upgrade, validator halt, or consensus disagreement on the Polygon PoS network, BlazingNode reserves the absolute discretion to determine which branch of the blockchain to support. BlazingNode does not guarantee support for minority forks and assumes no liability for failed, delayed, or orphaned transactions resulting from underlying protocol-level disruptions or chain splits.

BlazingNode may monitor usage patterns to detect abuse, enforce limits, and maintain system stability.

Actions may be taken without prior notice when necessary.

BlazingNode does not guarantee uninterrupted availability.

Service interruptions may occur due to:

• maintenance
• infrastructure failures
• network conditions
• blockchain-related issues

To the maximum extent permitted by law, BlazingNode shall not be liable for:

• financial or trading losses
• missed opportunities
• delayed or failed transactions
• service interruptions
• data loss

The service is provided “as is” and “as available”.

Free and Community Endpoints: Any public, trial, or free-tier endpoints (including public.blazingnode.com) are provided strictly on an “as is” and “as available” basis with zero uptime commitment, no SLA, and no service warranties of any kind. BlazingNode reserves the absolute right to rate-limit, throttle, block, or permanently discontinue public access at any time without prior notice or liability.

Blockchain Reorgs and Gas Fees: Users explicitly acknowledge that blockchain state transitions are decentralized and subject to chain reorganizations (reorgs), network gas spikes, and consensus delays outside BlazingNode’s control. BlazingNode shall not be liable for gas fees incurred on reverted transactions, slippage losses, liquidation events, or failed arbitrage/bot execution.

Aggregate Liability Cap: To the maximum extent permitted by applicable law, the total cumulative liability of BlazingNode, its parent entity (Evolution in Motion Inc.), and their directors, officers, and agents arising out of or relating to the service or these Terms shall not exceed the lesser of: (a) the total amount actually paid by the user to BlazingNode in the three (3) months preceding the incident giving rise to liability, or (b) one hundred Canadian dollars (100 CAD). For free, trial, or community tier users, BlazingNode’s total liability shall be zero.

Users agree to indemnify and hold harmless BlazingNode from any claims, damages, or liabilities arising from:

• misuse of the service
• violation of these Terms
• unlawful activity

BlazingNode may suspend or terminate access:

• for violations of these Terms
• for abusive or harmful usage
• to protect infrastructure or other users

Termination may occur without prior notice.

BlazingNode may modify pricing, limits, features, and these Terms. Continued use constitutes acceptance.

Governing Law and Exclusive Jurisdiction: These Terms and any dispute, claim, or controversy arising out of or relating to the service or these Terms shall be governed by and construed in accordance with the laws of Canada and the Province of Quebec, without regard to conflict of law principles. Any legal action or proceeding shall be brought exclusively in the competent courts located in the judicial district of Montreal, Province of Quebec, Canada, and each party irrevocably submits to such personal jurisdiction and venue.

Class Action Waiver: To the maximum extent permitted by applicable law, all claims and proceedings must be brought on an individual basis. Users expressly waive any right to initiate, join, or participate as a plaintiff or class member in any class action, collective proceeding, representative action, or private attorney general lawsuit against BlazingNode, Evolution in Motion Inc., or their officers, directors, and employees.

This Acceptable Use Policy defines permitted and prohibited uses of BlazingNode services.

Its purpose is to ensure system stability, fair access, and operational integrity.

Users must:

• operate within plan limits
• use the service responsibly
• avoid behavior that negatively impacts other users or infrastructure

Users may not:

• generate excessive load beyond intended usage patterns
• attempt to degrade or disrupt infrastructure performance
• perform denial-of-service or stress-testing activities
• bypass or attempt to bypass system limits or protections
• use the service for unlawful activities
• attempt unauthorized access or exploitation
• reverse engineer or interfere with system operation

Sanctions and Prohibited Jurisdictions: Users represent and warrant that they are not located in, organized under, or a resident of any country or territory subject to comprehensive sanctions or trade embargoes enforced by the Government of Canada, the United States (OFAC), or the United Nations. The service may not be used in connection with sanctioned individuals, designated smart contract addresses, money laundering, terrorist financing, ransomware distribution, or the exploitation of stolen digital assets.

BlazingNode supports automated systems, but certain behaviors may be considered harmful, including sustained high-frequency bursts beyond reasonable thresholds, abnormal traffic patterns affecting system stability, and usage that disproportionately consumes shared resources.

BlazingNode may monitor usage patterns to detect abuse or anomalies, enforce service limits, and maintain system performance. Monitoring may be automated and continuous.

BlazingNode may take action without prior notice, including:

• request throttling
• temporary restrictions
• suspension of access
• permanent termination of accounts

Users may not attempt to circumvent rate limits, access controls, or security mechanisms. Any attempt to bypass protections is considered a violation.

BlazingNode prioritizes system reliability, consistent performance, and fair resource distribution. Protective measures may be applied proactively.
